By visiting SWEET SOLUTIONS, contracting services, custom design work, purchasing premade layouts and premade WordPress themes, when offered, PDFs, digital photos, and any other work(s) and/or services offered, and utilizing FREE downloads, when offered, you agree to all terms, conditions, policies, and procedures stated herein.
Services, designs, web sets, themes, premade layouts, PDFs, and/or other site elements offered at SWEET SOLUTIONS are not available for use on adult content sites or any site promoting child abuse, violence, hate, bigotry, racism, animal abuse, pornography, and/or illegal activities.
Designs and/or graphics offered at SWEET SOLUTIONS are not to be made available in any collection, redistributed, or re-sold.
You may not claim authorship on anything offered at SWEET SOLUTIONS. SWEET SOLUTIONS retains copyright on all design work; the artists and photographers, whose graphics, photos, and/or illustrations are used on any design, retain their respective full copyrights. Copyright, logos, and/or links for SWEET SOLUTIONS and any other graphic/photo/script sources must remain intact and be clearly displayed on all pages of custom designs, premade layouts, themes, templates, PDFs, and/or other site elements designed by and/or offered for sale at SWEET SOLUTIONS. No downloading or direct-linking is permitted.
SWEET SOLUTIONS reserves the right to add to our portfolio site information (including site name, URL, screenshot, and date) for custom designs, purchased collections, premade layouts, eCommerce sites, page layouts, themes, templates, PDFs, and/or other site elements designed by SWEET SOLUTIONS. Site remodels thru Elance are negotiable.
The following applies to all designs, whether custom or premade:
- Layouts are created in Mozilla Firefox 2.0.0.18 at 1680 x 1050 resolution combining standard HTML/XHTML/HTM, CSS, PHP, Ajax, and JavaScript.
- All pages are tested in the latest versions of both Mozilla Firefox and Internet Explorer.
- All pages validate as HTML 4.01 Transitional or XHTML 1.0 Transitional, unless noted otherwise.
- Special care is taken to meet W3C accessibility guidelines.
- Designs/layouts are offered "as is" and without warranty of any kind, either expressed or implied, including, but not limited to, the client/customer's ability or inability to use the design.
Because of their digital nature, ALL SALES ARE FINAL.
General Terms and Conditions apply on all custom work.
You are encouraged to contact SWEET SOLUTIONS with any questions relating to custom work. All consultations are free.
- To start a project, client should email us or complete a Quote Request Form.
- There is NO COST. . .NO OBLIGATION for a custom design quote.
- Client will assign one (1) authorized representative to act on behalf of client as primary contact (hereinafter called "client") for all correspondence, project decisions, approvals, and payment, and this person will be named in project quote as "contact."
- Using information provided in the Quote Request Form or by email, SWEET SOLUTIONS will draw up and send to client a project quote, including possible design elements, approximate costs, and time needed for completion. Up to three (3) mockups (flat screenshots) of proposed designs/layouts may also be sent.
- The project quote is subject to change and revision before final approval.
- Project quotes are valid for thirty (30) days from date issued.
- When a project proposal is accepted, client is required to sign off on a contract (project outline, proposed layout, cost estimate, and copy of these Terms and Conditions). A digital signature via email confirmation is acceptable.
- A 50% down payment (of the total cost estimate) is due at time the contract is signed. Balance is due at time of completion.
- Project will start when the 50% down payment is received.
- On larger projects, there may be monthly billing for work completed with the balance due at time of completion.
- Throughout design/development process, SWEET SOLUTIONS will maintain regular contact with client, by email or phone, and will provide project updates with mockups (screenshots) and/or live (online) displays of project progress.
- Design of site layout will proceed one page at-a-time. Unique elements and content, including text, if any, will be added to each page. A mockup of the page layout will be presented to client. Revisions will be made as needed, but are limited to three (3) rounds of revisions per page. A revision is ANY request for change to the proposed layout. Any and all revisions to the proposed page layout must be made prior to the start of coding.
- In the case of slideshows, contact forms, registration forms, or other active design elements and/or JavaScript, where coding is required for development, client must provide clear specifications prior to coding. Minor changes will be made, but revisions are limited to no more than three (3) rounds that do not involve changes in the coding, i.e., font sizes, colors, different photos.
- Once a mockup and/or design element is approved, client will sign off on the page layout and/or design element (via digital signature). Any further revisions will result in additional fees.
- Coding begins only after the page layout has been approved. The approved layout will remain static throughout the development process. Any revisions to an approved layout after coding begins will result in additional fees.
- Additional fees incurred during the design/development process will be added to the balance due.
- Any and all logos/photos/illustrations/graphics and text that client wants incorporated into the design must be provided by client in digital form, either on a CD or by email.
- SWEET SOLUTIONS will make simple adjustments to logos/photos/illustrations/graphics provided by client, such as changes in resolution and size, and standard cropping at no extra charge. Complex color adjustments, image manipulation, and special effects will incur additional fees. Also, if client prefers to send hard copy of logos/photos/illustrations/graphics for scanning or SWEET SOLUTIONS is asked to retrieve existing images from client's existing site, there will be additional fees. All logos/photos/illustrations/graphics provided by client must include source information for site credit. If purchased graphics are used, the graphic artist's terms must be followed.
- Text provided by client must be ready for publishing and provided in Word or Notepad format. SWEET SOLUTIONS will correct spelling and/or grammatical errors. Transcription of hard copy (i.e., text sent in PDF format) and/or extensive copy editing will incur additional fees.
- To prevent additional fees for photo scanning, photo manipulation, text transcription and/or copy editing, etc, client should mention that there will be a need for these services prior to signing contract so that SWEET SOLUTIONS can include these services as part of the agreement.
- Photos/illustrations/graphics purchased by SWEET SOLUTIONS on behalf of client will be paid for by client. These charges, considered additional fees, will be added to the balance due.
- Client will provide any and all logos, photos/illustrations/graphics, and text in a timely manner. If (1) client fails to provide said content in a timely manner, and (2) project is complete except for said content, and (3) time frame allotted for project in contract has expired, the project may be terminated by SWEET SOLUTIONS and considered complete with the full balance due, plus any additional fees incurred, before release of files to client.
- Copyright and links for SWEET SOLUTIONS and/or other photo/illustration/graphic and script sources must remain intact and be clearly displayed on all pages of project design.
- Upon completion, custom project is uploaded to our server for an online run-through, testing, and final approval (via digital signature).
- Balance, plus additional fees incurred during the design process, if any, are due at time the project is completed and approved.
- When the balance due is received, a zip file of completed project files will be sent to client via email.
- Client has the option of uploading the custom project, or we will do it at no extra charge.
- It is strongly recommended that client keeps the zip file protected or makes a backup copy of the completed project files. SWEET SOLUTIONS keeps copies of all completed projects; however, there are additional fees to restore a project or re-send any file(s) once the zip file has been sent.
- A backup CD with all project files is available for purchase.
- Completed custom projects/designs (including site name, URL, screenshot, and date completed) may be added to our portfolio. We reserve the right to display original layouts created prior to client changes.
General Terms and Conditions apply on all WordPress projects (hereinafter called "themes").
- Themes are pre-coded for WordPress only. Client must have WordPress installed to use a theme. For SWEET SOLUTIONS to install WordPress, there is an additional fee.
- Themes consist of stylesheet and all files needed for a fully-functional WordPress blog/website. Search, RSS, calendar, contact forms, and other design features/plug-ins/scripts are considered optional and must be requested for by client prior to contract.
- Sidebar menu displays are limited to setup and ultimately depend on the client's WordPress settings.
We accept personal checks, cashier checks, money orders, and credit cards through PayPal. Personal checks, cashier checks, and money orders will require additional time to process. PayPal is the preferred method. It is fast, easy and secure. You do not need an account with PayPal to use it. All funds are USD. We do not accept cash.
Return checks/payments are subject to a $35 USD fee.
Non-payment of any monies due will result in legal prosecution.
In the event a custom project is cancelled, design work will stop immediately and a prorated refund, if any, will be sent.
Refunds for custom cancellations are calculated using the project quote total, plus any additional fees incurred, minus fees for work completed based on SWEET SOLUTIONS current Pricing List. Fees for work completed include, but are not limited to, standard fee for design of initial layout plus costs to set up pages and incorporate menus, scripts, photos/illustrations/graphics, text, and other design elements into the layout.
If the work completed exceeds the down payment and/or other moneys paid by client, client will be invoiced for the balance due.
On all custom cancellations, SWEET SOLUTIONS will release only that part of project paid for by client.
SWEET SOLUTIONS makes no warranty on the usability of a cancelled project.
There is no FREE customer support on cancelled projects.
On premade layouts and WordPress themes, when offered, ALL SALES ARE FINAL. . .there are no refunds.
Content and information on this website are copyrighted material owned by SWEET SOLUTIONS. Artwork, typography, photographs and graphics used throughout this site belong to SWEET SOLUTIONS or the respective designers and/or other credited sources. All rights are reserved. Downloading, re-transmission, or other copying or modification of trademarks and/or contents herein may be a violation of federal trademark and/or copyright laws and may subject the copier to legal action. Except as expressly provided, nothing on this site is available for sale, nor may it be reproduced, stored in a retrieval system or transmitted in any form or by any means—electronic, mechanical, photocopying, recording, or otherwise—without prior written permission from SWEET SOLUTIONS with the exception of citing or referring to the information provided on this site in books, online services, or other media, where only a small portion is reproduced for sample or review purposes.
